HemşireM — Terms of Use

These Terms of Use ("Terms") govern the use of the HemşireM mobile application ("App"), developed by Yakup Habanoğlu (individual/indie developer) ("Developer", "we"). By downloading the App, creating an account, or using the App, you represent that you have read, understood, and agree to these Terms. If you do not accept these Terms, you must not use the App.

1. Description of the Service
HemşireM is a shift and schedule planning mobile application (Android and iOS) designed for nurses in Turkey. The App primarily offers the following functions:
- Shift and schedule planning: Creating unit schedules, managing staff and shifts, a manual calendar, shift swaps, and keeping past records.
- Schedule sharing: A charge nurse shares a schedule with their team using a 6-digit join code; team members use this code to download the schedule and, by matching themselves in the list, see their own shifts and on-device reminders.
- Read-only nurse news: A list of headlines pulled from the RSS feeds of third-party sources (Sağlık Aktüel, Anadolu Ajansı). This is a read-only feature; when you tap a news item, the content opens on the source's own website in your device's browser.
The App is a decision-support tool. It may offer schedule-arrangement suggestions and visualizations; however, the final decision and responsibility regarding shifts and schedules always rest with the user and the institution to which the user is affiliated (see Section 5).
2. Eligibility (Who May Use It)
- To use the App, you must be at least 18 years old. The App is a professional tool intended for adult healthcare workers and is not directed at children.
- The App is designed for nurses and related healthcare workers.
- By using the App, you represent that you have the legal capacity to accept these Terms.
3. Account and Sign-In
- Sign-in to the App is performed via the Firebase Authentication infrastructure using Sign in with Google or Sign in with Apple.
- During sign-in, only your email address and your Firebase user ID (UID) are processed. Your real name is not displayed in any community/sharing area within the App; your identity is used only to match you to your own shifts.
- You are responsible for the security of your account and sign-in credentials. You are held responsible for activities carried out through your account.
- Account deletion: You can delete your account via the Settings > "Delete account" option within the App. With this action, the schedules you have published to the cloud, your join codes, and your Firebase Authentication account are permanently deleted. Data stored locally on your device is deleted when you uninstall the App.
4. User Obligations
When using the App, you agree to comply with the following obligations:
- Accurate data: You are responsible for ensuring that the information you enter (unit, staff, shift information, etc.) is accurate and up to date.
- Other people's data: When entering information belonging to another person into the App (for example, the names and positions of your team members), you represent and warrant that you are authorized to enter and process this data and that you are acting in compliance with applicable legislation (in particular KVKK — Turkey's Personal Data Protection Law No. 6698). You are responsible for the lawful processing of data belonging to third parties and, where necessary, for informing the relevant individuals.
- Prohibition of misuse: You will use the App only for lawful purposes and in accordance with these Terms. Misuse is prohibited, including but not limited to:
- Using the App for illegal, fraudulent, or harmful purposes;
- Attempting to access or alter another user's data without authorization;
- Attempting to disrupt the security, integrity, or operation of the App or its infrastructure (for example, reverse engineering, sending automated/excessive requests, attempting to manipulate systems);
- Using join codes or sharing features to access schedules you are not authorized to access.
- Violation of these obligations may result in the suspension or termination of your access to the App (see Section 11).
5. Schedule Responsibility
Responsibility for schedules rests entirely with the user.
- HemşireM is a decision-support tool; it makes it easier to create, visualize, and share schedules. However, the final responsibility for the accuracy of shift assignments, their compliance with legislation and institutional rules, and the fulfillment of legal requirements regarding working hours and rest periods rests with the user.
- The final approval, validity, and implementation of schedules created or shared through the App belong to the institution to which the user is affiliated and to the authorized supervisors. The official/binding schedule is the one approved by your institution.
- The Developer makes no warranty as to the accuracy, completeness, or legal compliance of schedules created through the App and accepts no responsibility in these matters.
6. Not Medical Advice
HemşireM is a planning and organization tool. The App and its content (including news):
- Do not constitute medical, clinical, legal, or professional advice.
- Do not replace your professional judgment, institutional procedures, or the opinions of competent authorities.
You must always make your clinical or professional decisions according to your own professional judgment and your institution's rules.
7. News and Third-Party Content
- The news section in the App consists of headlines pulled on a read-only basis from the RSS feeds of third-party sources such as Sağlık Aktüel and Anadolu Ajansı.
- All rights to this content belong to the respective source organizations, and the content is displayed with attribution to its source. When you tap a news item, the content opens on the source's own website in an external browser.
- The Developer is not responsible for the accuracy, timeliness, completeness, or legality of content from third-party sources and does not support or endorse this content. Third-party sites' own terms of use and privacy policies apply.
- No user data is sent to these sources when news is fetched.
8. Intellectual Property
- All intellectual property rights in the App itself, its design, interface, logo, brand (including the name "HemşireM"), and software belong to the Developer.
- Provided that you comply with these Terms, you are granted a non-transferable, non-exclusive, limited right to use the App for personal and professional purposes.
- You may not copy, reproduce, modify, distribute, sell, rent, or reverse engineer the App.
- The data you enter into the App yourself (staff, shifts, etc.) belongs to you; you are responsible for the authority to process and share it.
9. Limitation of Liability
- The App is provided "as is" and "as available". The Developer makes no express or implied warranty that the App will be uninterrupted, error-free, or always accessible.
- To the maximum extent permitted by applicable legislation, the Developer is not liable for indirect, incidental, special, or consequential damages arising from the use or inability to use the App, data loss, schedule errors, or interruptions or errors in third-party services (Google, Apple, RSS sources).
- The Developer acts as an individual developer. The App is not intended to replace an institutional shift/schedule system; for official records, your institution's systems should be relied upon.
- This Section does not affect a consumer's rights arising from applicable legislation that cannot be limited by contract.
10. Pricing and Subscription
- Use by nurses is completely free. No fee is charged for a nurse to join a shared schedule with a code, view their own shifts, receive on-device reminders, and read the news.
- Charge nurse/professional features are subject to a paid subscription. Advanced features for charge nurse/professional use, such as creating, managing, and publishing schedules to the cloud, may be offered under a paid subscription.
- Subscriptions are purchased through the App Store (Apple) and Google Play (Google). The current price is shown in the relevant store at the time of purchase.
- Subscriptions are managed and canceled through the user's store account and are subject to the rules, payment, and refund policies of the relevant store (Apple App Store / Google Play). Purchase, renewal, billing, and refund transactions are handled by the relevant store.
- During the launch/promotional period, free access to professional features may be granted through a limited number of promotional codes. This access may be temporary and may be terminated by the Developer.
11. Termination
- If you violate these Terms, the Developer may suspend or terminate your access to the App without prior notice.
- You may stop using the App at any time and terminate these Terms by deleting your account via Settings > "Delete account".
- Upon termination, provisions that by their nature must remain in effect (intellectual property, limitation of liability, governing law, etc.) continue to apply.
- If there is an active subscription, the cancellation and refund conditions of the subscription are subject to the relevant store's policies.
12. Changes to the Terms
- The Developer may update these Terms from time to time. In the event of significant changes, notice will be provided by a reasonable method (for example, within the App or on this page with an updated "Effective Date").
- Your continued use of the App after the changes take effect means that you accept the updated Terms. If you do not accept the updated Terms, you must stop using the App.
13. Governing Law and Competent Court
- These Terms are governed by and construed in accordance with the laws of the Republic of Turkey.
- The courts and enforcement offices of the Republic of Turkey have jurisdiction over disputes that may arise from these Terms. The rights of users who qualify as consumers regarding the choice of competent court/authority arising from applicable consumer legislation are reserved.
